These Terms of Use (hereinafter - the "Terms") determine the rules of use of the Program. The Terms of Use are binding and are an integral part of the agreement under which the Client had received the right to use the Program from FieldBI (hereinafter - the "agreement").
The Client and users have the right to use the Program only if they read and fully and unconditionally agree to these Terms. The Client has the right to provide the user with access to the Program only if the Client is convinced that the user has read and agreed to these Terms. The Client is fully responsible for the user's actions.
Description
FieldBI offers an online tool - a comprehensive expert-analytical information system for agribusiness management.
Accounts and other data of clients and users, registration
When registering for access to the Program, FieldBI requires the Client to provide a name, telephone number, e-mail address, company name, position of the Client's / user's representative in the specified company, number of hectares cultivated by the Client. Please carefully read our Privacy Policy where is detailed, what data we collect, how we store and use the Client's personal data, who may have this data and the legal basis for such data processing. After registration, FieldBI provides the Client with data for authorization in the system.
The Client is obliged to provide accurate and complete information requested by the form of registration about himself and users, and keep this information up to date. FieldBI has the right at any time to require the Client to provide additional information and documents to confirm the above information.
In case if the Client provides inaccurate or incomplete information, fails to provide relevant information, failes to provide documents to confirm the information, FieldBI shall have the right to block or delete the account of the user, and terminate, suspend or restrict access to the Program and its use by the Client.
Using the Program
By using the Program, the Client shall receive a license for personal use only. Client may not sell the Program, share the license with anyone else, attempt to copy the Program, or attempt to make money from it without the express written permission of FieldBI. If FieldBI offers the use of the system free of charge, the Client must also comply with these provisions and not copy or otherwise use the Program in the manner prohibited by this section. Customer does not acquire ownership upon purchase of the Program, but purchases (or receiving, in the case of free access) a license to use the FieldBI Program. By using the FieldBI Client Program, you assume responsibility for the use of the Program by the Client and the Client's users. The Client is responsible for the use of the Program made through the Client's account and the Client's users.
Warranties, reservations and liability
Materials and services of the system are provided "as is" without any guarantees. FieldBI may at any time, without notice, make changes to the materials and services provided, as well as to the services, products and prices mentioned therein.
Under no circumstances FieldBI shall be liable for any damages (including, but not limited to, damages from loss of profits, data, or business interruptions) resulting from the use, inability to use, or results from the use of this Program.
FieldBI reserves the right to suspend or restrict access to the Program or any part thereof.
FieldBI warrants that it has all the rights to grant the Client the right to use the Program under the Agreement.
The Client is obliged to indemnify FieldBI for all damages caused by its violation by him and / or users of these Terms and Conditions.
In any case, the amount of FieldBI's liability to the Client may not exceed the cost paid by the Client to grant the right to use the Program.
Use of personal data
FieldBI uses various technologies to collect and store information when the Client visits the site. This may include recording one or more cookies or anonymous IDs. FieldBI also uses cookies and anonymous identifiers when the Client interacts with services offered by FieldBI partners, such as advertising services, like those that may appear on other sites. Fee for using the service
Payment for the use of the Service shall be made by paying the invoice by the Client. In case if the payment for the Service is not made in time, the Service reserves the right to restrict fully or partially the access of such Client to the Program.
Intellectual property rights
The program is a creation and is protected by the legislation of Ukraine on copyright.
The Program shall not be transferred to the Client's possession, disposal or ownership. The Client shall have no right to transfer, sell or otherwise alienate the Program or transfer the rights to it to third parties (except as expressly provided in the Agreement). All intellectual property rights to the Program are reserved.
The design of the Program, as well as the created FieldBI texts, scripts, graphics, functions, logos are the property or license of the company "FIELDBI", which are subject to protection as objects of intellectual property rights. Customer agrees not to participate in the use, copying or distribution of anything contained on the Site or the Program without the express written permission of FieldBI.
Liability for infringement of intellectual property rights arises in accordance with the current legislation of Ukraine.
